On 13 January 2020, the Sabayil District Court of Baku City found Zamin Salayev guilty of committing an administrative offence under the Article 535.1 (disobedience to the policeman’s legal request) of the Code of Administrative Offences of the Azerbaijan Republic, and sentenced him to 1 month of administrative arrest.

Zamin Salayev was held in  the 8th police department of  the Sabail district of Baku, where he was subjected to cruel torture and inhuman and degrading treatment. According to the testimony of Salayev himself, in the 8th police department, he was severely beaten by 10-15 policemen, the beatings were led by captain  Hamza Azizov.               

As a result of the beating, he suffered a burst hernia on his abdomen. And the policemen had to call for doctors from the Ministry of Interior Hospital, who stated the necessity of the operation, but the policemen did not authorize them to do it.

On 24 January 2020, the staff of the Ombudsman’s Office visited Z. Salayev. However, they declared that there were no signs of torture on Zamin Salayev’s body.

On 25 January 2020, Ehsan Zahidov, the Chief of the Press Service of the Ministry of Interior, was interviewed saying that all Zamin Salayev’s accusations against the police captain Hamza Azizov “have no legal grounds” and “Z. Salayev’s statements about torture are fictitious as well”.

All the accused on so-called “Ganja Case” testified about brutal tortures and inhuman treatment. Among police officers who used tortures, the officers of Ganja City Kapaz District  Police Division were mostly mentioned. Most of all, victims mentioned Shahin Musayev – Chief of Criminal Investigation Department of Ganja City Kapaz District Police Division, and also:

  • Vugar Qarayev – deputy chief of  the police division,
  • Elshan Mehtiyev – senior officer of the criminal investigation department of  the police division,
  • Nizami Askarov –  police division officer,
  • Vusal Qurbanov  – police division officer,
  • Huseyn Huseynzade  – officer of post-patrol service of Kapaz District Police Division.

Chief of Ganja City Nizami District Police Division

Sadiqov Adalat became a Chief of the Ganja City Nizami District Police Division in 2011.

During July- August 2018, there were arrested about 80 people on so-called “Ganja Case”.

At the trial, all the accused testified about the use of brutal tortures towards them during preliminary investigation, indicating that the Chief of the Ganja City Nizami District Police

Division Colonel  Adalat Sadiqov, personally, tortured people, including minor Emil Mammadov.

On May 2019, Colonel Adalat Sadiqov retired.

Detainees at the Ganja City Nizami District Police Division were also tortured by:

  • Afgan Ismayilov – senior officer of the criminal investigation department of this police division,
  • Alaskar Tagiyev – police division officer,
  • Baxtiyar Abbasov – police division officer, senior sergeant of police,
  • Parviz Maharramli – officer of the criminal investigation department of this police division,
  • Sanan Verdiyev – police division officer.

On March 30, 2019 Baku City Sabunchi District Court found Bayram Mamedov guilty under Articles 535.1. ((insubordination to legal demands of police) of The Code of Administrative Violations of AR and sentenced him to 30 days of administrative arrest.

 

B. Mamedov was kept in Ministry of Internal Affairs Detention Facility by administrative order. Given facility is situated at Baku City Binagadi District. There, B. Mamedov was exposed to brutal beatings, tortures. In result of beatings, he lost his consciousness.

Police Major-General Mirgafar Seidov, chief of the Main Department of Baku city Police (MDBP) personally directed the torture of a number of political prisoners. Bayram Mammadov and Giyas Ibrahimov, “monument prisoners”, were also brutally tortured in the MDBP and Migafar Seidov personally took part in this abuse.

 

Bairam Mammadov and Giyas Ibrahimov were charged with drug dealing. However, the real reason for their arrest was spraying graffiti on the monument to Heydar Aliyev, the father of President Ilham Aliyev.

 

Photos of the monument to Heydar Aliyev, located in the park in the center of Baku, with graffiti inscriptions on the pedestal were published on May 10 on social networks and some online publications. The inscription, in Azeri, read: “Qul bayramınız mübarək!” (Happy Holiday of Slaves!). 10th of May is a birthday of Heydar Aliyev and is celebrated by the Azeri government under the “motto” “Holiday of Flowers” – “Gül Bayramı” hence word play Gül – Qul (Flower – Slave). The Other side of the pedestal had an English inscription: “F … k the system!”. These Inscriptions were later erased, and a police guard was posted at the monument. Statement of torture against me
“On May 10, 2016 at around 14.00-15.00, three people in civilian clothes forced me into a white SUV car and brought me to the 12th police station and in to the chief of the police’s office with 8 civilian dressed people present.

 

They began to beat me with their hands, fists, and legs. They were asking why I photographed the monument, who are my accomplices, while continuously beating me.

 

I could not hear much because of the beating and lost consciousness. Being unconscious I could not remember the shape and brand of the car which was used to take me to MDBP, where they again began to beat me, in order for me to admit the charges of drugs dealing brought against me.

 

When I said that it was not true, and I have never even seen any drugs, they stated  that they could not arrest me for photographing the monument, and they started to beat me with even more anger, so that I would admit a false accusation of drugs … …

 

And when they threatened that they would strip my trousers and would commit indecent acts on me with a police club, I was forced to admit false accusations of drugs, and gave such explanations and testimonies as they demanded.

 

Then they took me to the general (Major-General Mirgafar Seyidov) and said that if I bring flowers to the monument, give an interview to AzTV and ask for forgiveness from the monument, they’ll let me go. When I refused, they took me away and beat me again. Then, at about 00.30 am, I was brought to Narimanov’s district Temporary Detenion Center. … .. .. ..

From July 19, 2016 to January 25, 2017, the Baku Court for Grave Crimes conducted a trial of 18 defendants on the so-called “Nardaran case”. Among them, the leader of the movement “Muslim Unity” Taleh Bagirov, members of this movement Abbas Huseynov, Rasim Dzhabrailov and others, as well as deputy chairman of the opposition party Popular Front of Azerbaijan Fuad Gahramanli.

During the trial, all the defendants testified that two policemen and four residents of the village of Nardaran were killed by police officers on November 26, 2015. Moreover, the residents of the villagers were killed by the police after they were detained.
Members of the movement “Muslim Unity” told about the cruelest tortures that they were subjected in November-December 2015 in the Main Department for Combating Organized Crime of the Ministry of Internal Affairs of AR. They provided convincing evidence of gross violation of the international law and legislation of Azerbaijan Republic by the police officers.
Taleh Bagirov testified that he was beaten and forced to testify against leader of the opposition party Popular Front of Azerbaijan Ali Keremli and chairman of the National Council of Democratic Forces Jamil Hasanli.

The accused told the names of the MIA officers who tortured them. Among them : senior operations inspector for especially important cases of Main Department for Combating Organized Crime (MDCOC) of the Ministry of Internal Affairs of AR Colonel -Lieutenant Islam Agabekov, chief of the MDCOC General-Major Seyfulla Azimov,Major Shahlar Jafarov (this name was called by all the accused), the head of the Anti-Terrorist Center of MDCOC Colonel Kerim Alimardanov (this name was also called by all the accused).

Also, all accused named Senior operations inspector for Especially Important Issues of MDCOC Colonel-Lieutenant Islam Agabekov, chief of the MDCOC General-Major Seyfulla Azimov and member of MDCOC Major Shahlar Jafarov.

After Mehman Huseynov disseminated information on tortures at Nasimi District Police Department, colonel M. Musayev filed the complaint, in which he indicated that M. Huseynov has blackened the police, accused police officers in committing especially serious crime, and that his actions falls under the Article 147.2 of the Criminal Code of the Azerbaijan Republic.

On March 3, 2017 Baku City Surakhany District Court found Mehman Huseynov guilty in committing the crime under the article 147.2 (slander, which is connected with accusation of committing serious or especially serious crime) of the Criminal Code of the Azerbaijan Republic and sentenced Mehman Huseynov to imprisonment for the term of two years..

On April 12, 2017 Collegiums on Criminal Cases of Baku Court of Appeal made the decision not to satisfy Mehman Huseynov appeal and left the decision of the court of first instance from March 3, 2017 without any change.

On April 29, 2014 Police Colonel Asadov Ismail – chief of Baku City Yasamal District Police Department headed police operation to arrest Leyla Yunusova and Arif Yunusov.

 

In the picture, taken on April 29, 2014, early in the morning in the yard of Yunusovs’ apartment building (in Baku city, at N.Narimanov ave. 125), colonel Ismail Asadov justifies the violence of police towards Leyla Yunusova, stating loudly, that she is not Azeri woman, but Armenian and that is why any violence towards her is justified.
